President John Dramani Mahama has begun consultation with the Council of State on petitions to remove Chief Justice Gertrude Araba Essaba Sackey Torkornoo; this is according to the Spokesperson to the President, and Minister for Government Communications late Tuesday.
According to a statement signed by Felix Kwakye Ofosu, the President has received three petitions from various persons seeking the removal of the Chief Justice.
“President Mahama has received three persons from various persons seeking the removal of the Chief Justice. The President has forwarded the three petitions to the Council of State to commence the consultation process mandated by Article 146 of the 1992 Constitution,” said the statement.
Article 146 (6) of the 1992 Constitution states, “Where the petition is for the removal of the Chief Justice, the President shall, acting in consultation with the Council of State, appoint a committee consisting of two Justices of the Supreme Court, one of whom shall be appointed chairman by the President, and three other persons who are not members of the Council of State, nor members of Parliament, nor lawyers.”
Clause 7 of the same Article also states, “The committee appointed under clause (6) of this article shall inquire into the petition and recommend to the President whether the Chief Justice ought to be removed from office.”
The then-opposition National Democratic Congress (NDC) led by its presidential candidate John Mahama accused the Judiciary of bias against the party. Enditem
